General terms of use of the service

Preamble and Articles 1 to 8

Preamble

1. The company G.T.L. GROUPE TRANSPORT LYONNAIS, a simplified joint-stock company with a share capital of 163,506 euros, whose registered office is located at 83, rue Jean Jaurès, 69500 BRON, France, registered with the Lyon Trade and Companies Register under number 801 256 330, operates, under the TAXI TL brand, a booking centre that puts customers in contact with independent taxi drivers affiliated to its network.

2. TAXI TL offers a service for searching for, booking and putting CUSTOMERS in contact with affiliated taxi drivers.

The taxi drivers physically perform the transport services as part of their independent professional activity.

This independence does not preclude the liabilities that may legally fall on G.T.L. in its capacity as a booking centre, in particular under the applicable provisions of the French Transport Code.

3. TAXI TL operates a booking centre offering its services mainly in Lyon, its metropolitan area and the geographical sectors served by the affiliated drivers.

The centre enables CUSTOMERS to request taxis, in particular by telephone, online or via dedicated tools, depending on the services available.

The number of affiliated drivers, the centre's staffing levels and the operational resources deployed may change according to the needs of the service.

These elements do not constitute a permanent contractual commitment as to the number of taxis available at any given time.

4. Taxis affiliated to TAXI TL may be fitted with communication and geolocation devices which, in particular, make it easier to search for, allocate and track available vehicles.

These devices are intended to improve the efficiency of the booking service and the quality of CUSTOMER pick-up.

Any processing of personal data associated with these devices is carried out in accordance with the applicable regulations and with the information set out in the TAXI TL privacy policy.

Article 1: Acceptance of the General Terms of Use

5. These General Terms of Use, hereinafter referred to as the "GTU", define the conditions under which TAXI TL offers its taxi search and booking services, by telephone or via its digital tools (app, website, etc.).

They apply in particular to immediate requests and to advance requests for taxis made as part of the ordinary booking service.

Certain specific services offered by TAXI TL are subject to particular General Terms and Conditions of Sale, hereinafter referred to as the "GTCS".

These include, in particular, certified booking services, services with online payment, the TL Eco, TL VIP, TL Minibus and TL Access services and shared rides, subject to availability.

When the CUSTOMER orders one of these particular services, the corresponding GTCS are communicated to them before their order is concluded.

In the event of any discrepancy between these GTU and the GTCS specific to a particular service, the specific provisions of the GTCS prevail for that service, subject to the applicable mandatory legal provisions.

6. The CUSTOMER is invited to read these GTU before placing an order.

When an order is placed using the digital tools, the applicable contractual terms must be accessible to the CUSTOMER before the order is finally validated.

For orders placed by telephone, the essential information relating to the terms of the service, whether or not it is guaranteed, the pricing conditions and the consequences of the CUSTOMER's absence is communicated in a manner suited to this channel.

Acceptance of the GTU takes place under the conditions laid down by the rules applicable to the conclusion of the contract.

Merely browsing the website does not, in itself, constitute contractual acceptance of the terms relating to taxi bookings.

The data recorded by TAXI TL in connection with orders may constitute evidence of the exchanges and transactions carried out, in accordance with the applicable legal provisions.

The CUSTOMER retains the right to challenge this evidence by any legally admissible means of proof.

Article 2: Taxi bookings

7. Taxi bookings may be made as an immediate request or as an advance request:

  • by telephone on +33 4 78 26 81 81;
  • online, from the www.tl.fr website, when the corresponding feature is available;
  • through the other digital tools (customer app, API connector, etc.).

The CUSTOMER must provide the information required to process their request, in particular the pick-up address, the desired time, the number of passengers, the particular characteristics of the ride and any specific needs.

§ 2.1 Immediate requests

8. When they wish to obtain a taxi as soon as possible, the CUSTOMER must state that it is an immediate request.

They must report any particularity likely to affect the search for a vehicle suited to their needs.

TAXI TL then searches for available taxis in the requested sector and, if necessary, in the surrounding sectors.

9. When a taxi appears to be available, TAXI TL may give the CUSTOMER an estimated arrival time for the vehicle.

This time is given for information only and may vary depending in particular on:

  • the actual availability of drivers;
  • traffic conditions;
  • weather conditions;
  • operational constraints;
  • any event likely to disrupt travel.

TAXI TL searches for or allocates a vehicle in accordance with the terms of the service offered.

Where the technical means allow it, information relating to the allocation or approach of the vehicle may be communicated to the CUSTOMER.

10. When no driver is available in the requested sector or in the surrounding sectors, TAXI TL informs the CUSTOMER.

The CUSTOMER may then be invited to renew their request at a later time.

§ 2.2 Advance taxi requests

11. An advance taxi request consists of TAXI TL recording a vehicle search to be carried out on a date and at a time set in advance.

As part of the ordinary service, this request may be recorded, subject to the technical and operational capacities of the service, between seven (7) days and forty (40) minutes before the desired travel time.

12. Any advance booking confirmed by TAXI TL constitutes a commitment to provide a taxi on the date, at the time and at the place agreed with the CUSTOMER.

TAXI TL is bound by an obligation of result as regards the performance of this booking, in accordance with the provisions of Article L. 3142-3 of the French Transport Code.

TAXI TL's liability may only be set aside in the cases of exemption provided for by law, in particular in the event of force majeure.

13. TAXI TL may have to decline certain advance requests when the available capacity is insufficient or when particular circumstances make their fulfilment uncertain.

Such situations may result in particular from strikes, demonstrations, bad weather, major traffic disruption or an exceptional concentration of requests.

Where possible, TAXI TL informs the CUSTOMER of the difficulties encountered and may offer them other time slots.

14. If no taxi has arrived five (5) minutes after the pick-up time initially requested, the CUSTOMER is invited to contact the TAXI TL switchboard on +33 4 78 26 81 81.

The switchboard will be able to give them the available information on the status of the search or the possible arrival of a vehicle. TAXI TL implements appropriate means to monitor the request and keep the CUSTOMER informed. This step does not deprive the CUSTOMER of the rights they hold under the applicable legal provisions.

§ 2.3 Specific bookings and particular vehicles

15. In addition to standard bookings, TAXI TL offers specific services requiring the provision of a vehicle meeting the particular needs of the CUSTOMER (adapted vehicle, minibus, premium vehicle or any other particular service).

These services are subject to express confirmation by TAXI TL and, where applicable, to the General Terms and Conditions of Sale specific to the chosen service.

16. The provision of these vehicles may entail particular pricing or additional charges, subject to their compliance with the applicable regulations and to their prior acceptance by the CUSTOMER.

The characteristics of the service, the pricing conditions and the terms for modification and cancellation are communicated to the CUSTOMER at the time of booking.

§ 2.4 Passenger pick-up

17. The CUSTOMER must be at the agreed pick-up location and ready to board the taxi at the stated time.

In the case of an immediate request, they must be available as soon as the vehicle arrives at the address given.

In the case of an advance request, they must be present at the agreed time.

For ordinary requests, unless particular information is brought to the CUSTOMER's attention when the order is placed, the driver may be authorised to leave the pick-up location after five (5) minutes of waiting.

Particular services subject to specific GTCS may provide for other waiting times.

These may include, in particular, a period of ten (10) minutes for certain certified bookings or five (5) minutes for a fellow passenger.

The waiting time applicable to the service ordered is the one communicated to the CUSTOMER before their booking is concluded.

The CUSTOMER is invited to inform TAXI TL as soon as they become aware of a delay or an impediment.

§ 2.5 Abandoned booking, passenger not picked up

18. When a taxi has actually travelled following an ordinary request and the CUSTOMER does not appear at the agreed location, or refuses the pick-up without legitimate reason, sums may be claimed under the legally applicable conditions.

Any invoicing must be based on objective and verifiable elements justifying the journey made, its pricing basis and the sums due.

The invoicing conditions must have been brought to the CUSTOMER's attention before the order was concluded.

Any amounts claimed must comply with the pricing regulations applicable to taxis and cannot automatically be treated as the full price of a ride that did not take place.

Where direct payment to the driver concerned is impossible, TAXI TL may, where the legal and contractual conditions allow it, send the CUSTOMER an invoice or a substantiated payment request on behalf of the driver.

The CUSTOMER retains the right to challenge the sums claimed.

The particular conditions applicable to prepaid services, certified bookings and other specific services are defined in the corresponding GTCS, subject to mandatory legal provisions.

Article 3: Pricing conditions for telephone bookings

19. For ordinary taxi search requests made by telephone, TAXI TL does not charge the CUSTOMER any connection fee, except for a particular service expressly announced and accepted.

The transport service is invoiced in accordance with the pricing regulations applicable to taxis.

Unless particular terms are agreed at the time of booking, the CUSTOMER pays the fare directly to the taxi driver.

The applicable fares are determined in accordance with the scales and regulatory provisions in force.

Particular services, such as bookings, services at an announced price, specific options or services paid for online, may be subject to separate pricing conditions.

These conditions are communicated to the CUSTOMER before their order and appear, where applicable, in the applicable GTCS.

Any fare estimate given for information does not constitute a firm price commitment, unless expressly stated otherwise.

Article 4: Liability of TAXI TL

20. TAXI TL acts as a booking centre putting CUSTOMERS in contact with affiliated taxi drivers.

In the course of this activity, G.T.L. performs the obligations incumbent on it in accordance with the applicable laws and regulations.

Where the services offered fall within the scope of Article L. 3142-3 of the French Transport Code, G.T.L. is liable as of right towards the CUSTOMER for the proper performance of the obligations arising from the transport contract, subject to the grounds for exemption provided for by law.

21. TAXI TL implements appropriate means to search for an available taxi, to process the requests received and to communicate to the CUSTOMER the information useful for monitoring them.

The availability of a vehicle constitutes a guaranteed commitment only where the chosen service and the conditions for confirming the order expressly provide for it.

For an ordinary request, any arrival times communicated are estimates.

22. Certain events beyond the usual operation of the service may cause delays, disruption or make performance impossible.

These may include in particular:

  • IT failures;
  • disruption of telecommunication networks;
  • strikes or demonstrations;
  • severe weather;
  • road accidents;
  • exceptional traffic jams;
  • events that may qualify as force majeure.

TAXI TL's liability in these circumstances is assessed in accordance with the applicable legal provisions.

The mere occurrence of one of these events does not automatically constitute a ground for exemption from liability.

23. Taxi drivers affiliated to the TAXI TL network carry out their professional activity independently.

They physically perform the transport services and assume the obligations incumbent on them personally in their capacity as professional carriers.

This independence cannot have the effect of excluding the liabilities that the law attaches to the involvement of G.T.L. as a booking centre.

24. Any complaint relating to an order, a connection service or a ride carried out through TAXI TL may be sent:

By e-mail: commercial@tl.fr

By post:

G.T.L. GROUPE TRANSPORT LYONNAIS
Service Clients
83, rue Jean Jaurès
69500 BRON
France

TAXI TL examines the complaints received and seeks, where possible, an amicable solution.

Where the CUSTOMER is a consumer, they may, after a prior written complaint and subject to the legal conditions of admissibility, have free recourse to the consumer mediator to which G.T.L. is attached.

The up-to-date contact details of the competent mediator are made available to the CUSTOMER in the applicable contractual documents or in a section accessible on the www.tl.fr website.

Article 5: Personal data

25. In the course of its activity, TAXI TL collects and processes certain personal data necessary for the operation of the website and the provision of the services offered.

This data may concern in particular:

  • the CUSTOMER's identity and contact details;
  • telephone numbers;
  • e-mail addresses;
  • departure and destination locations;
  • the dates and times of rides;
  • the characteristics of the services requested;
  • the information required for invoicing;
  • information relating to complaints and order follow-up;
  • vehicle location data, where necessary for the service;
  • certain information required to organise adapted transport.

TAXI TL may also process certain information relating to telephone exchanges and to the orders placed, in particular for the purposes of managing the service, following up requests or providing evidence, where such processing has an appropriate legal basis.

Where telephone conversations are recorded, the persons concerned receive specific prior information on this arrangement, its purposes and the applicable rights.

Acceptance of these GTU does not, in itself, constitute general consent to the recording of conversations.

26. Personal data is processed in accordance with the General Data Protection Regulation, the French Data Protection Act as amended and the other applicable provisions.

Information on the purposes of the processing, its legal bases, the categories of recipients, the retention periods, any transfers of data outside the European Economic Area and the rights of the persons concerned is set out in the privacy policy for customers, available on the www.tl.fr website.

The data required to perform an order may in particular be communicated to the drivers concerned and to the technical service providers involved in providing the service, under the conditions laid down by the applicable regulations.

The persons concerned have, under the conditions laid down by law, rights of access, rectification, erasure, objection and restriction of processing, as well as, where the conditions are met, a right to data portability.

These rights may be exercised by contacting:

By e-mail: privacy@tl.fr

By post:

G.T.L. GROUPE TRANSPORT LYONNAIS
83, rue Jean Jaurès
69500 BRON
France

The persons concerned also have the right to lodge a complaint with the French data protection authority, the Commission Nationale de l'Informatique et des Libertés (CNIL).

The use of cookies and other trackers on the www.tl.fr website is the subject of separate information.

Cookies that are not strictly necessary are subject to the choices expressed by the user in the consent management tool, in accordance with the applicable rules.

Article 6: Online taxi bookings

27. In addition to its telephone booking centre, TAXI TL offers on the www.tl.fr website features enabling CUSTOMERS to make taxi requests and, depending on the services available, to make particular bookings.

Certain services may require the creation of a user account, a specific confirmation or an online payment.

28. The conditions applicable to an order placed online depend on the nature of the service selected by the CUSTOMER.

Ordinary taxi requests are governed by these GTU.

Particular services, in particular those involving a certified booking, an agreed price, a prepayment or specific cancellation conditions, are also subject to the corresponding GTCS.

The applicable contractual information is presented to the CUSTOMER before their order is finally validated.

§ 6.1 Online booking procedure

29. When the service is available on the website, ordinary orders may be placed:

  • as an immediate request, in accordance with paragraph 2.1;
  • as an advance request, in accordance with paragraph 2.2.

Particular services are offered according to the terms specific to each service.

30. To place an order online, the CUSTOMER must fill in the information requested in the booking forms.

The fields identified as mandatory must be completed so that the request can be processed.

The CUSTOMER is responsible for the accuracy of the information they provide.

Before validating their order, they must be able to read the essential characteristics of the service, the applicable conditions and, where applicable, the price and the payment terms.

The mere technical receipt of a form does not necessarily constitute confirmation of a guaranteed booking.

Such a guarantee exists only where it has been expressly offered and confirmed by TAXI TL.

Where the order entails an obligation to pay, the validation process must enable the CUSTOMER to explicitly acknowledge this obligation, in accordance with the provisions applicable to the conclusion of contracts by electronic means.

31. The ordinary taxi search service offered on the www.tl.fr website is free of charge for the CUSTOMER, unless a particular cost has been indicated beforehand and expressly accepted.

The amount of the transport service is determined in accordance with the applicable pricing rules.

Services involving a certified booking, remote payment or specific pricing conditions are governed by the corresponding GTCS.

§ 6.2 Applicable law and settlement of disputes

32. These General Terms of Use are governed by French law, without prejudice to any mandatory protective rules applicable to consumers.

In the event of a dispute relating to the interpretation, validity or performance of these terms, the parties shall endeavour, as far as possible, to seek an amicable solution.

The consumer CUSTOMER retains the right to have recourse to consumer mediation under the conditions laid down by law.

Failing an amicable resolution, the competent courts are determined in accordance with the applicable legal rules.

Where the CUSTOMER is a trader, a clause conferring jurisdiction on the Lyon Commercial Court can only take effect under the conditions laid down by law, in particular where it has been specified very conspicuously in the undertaking of the party against whom it is relied upon.

Article 7: "Quote request" service

33. TAXI TL may make available to users of the www.tl.fr website a service for obtaining an indicative estimate of the fare for a taxi ride.

This estimate is established in particular on the basis of:

  • the departure and destination addresses provided by the user;
  • the available map data;
  • the estimated distance and route;
  • the pricing parameters taken into account by the service.

The amount displayed is an indicative estimate and cannot, unless expressly offered otherwise, be treated as a contractually guaranteed price.

The price actually due is determined in accordance with the pricing regulations applicable to taxis and, where applicable, with the particular conditions of the chosen service.

Nor does the estimate constitute a guarantee that a vehicle is available.

Where the estimate tool uses Google Maps services, the user may consult this provider's terms of service and privacy policy from the links provided in the interface.

Any use of cookies or trackers that are not strictly necessary in connection with these services is subject to the applicable consent rules.

Article 8: Amendment of the General Terms of Use

34. TAXI TL reserves the right to amend these General Terms of Use in order, in particular:

  • to adapt their content to changes in the services offered;
  • to take account of legal and regulatory developments;
  • to incorporate technical or operational changes;
  • to improve users' understanding of the applicable terms.

Any new version of the GTU is made available on the www.tl.fr website and identified by its update date.

The amendments apply to uses and orders subsequent to their entry into force.

They cannot have the effect of retroactively modifying the contractual terms applicable to an order already concluded, except in the cases permitted by law.

Where a substantial amendment concerns a contractual service in progress, the CUSTOMER is informed under the conditions and within the time limits laid down by the applicable regulations.
